Appeals of ECSA Decisions

Any party affected has the right to appeal the decision of the Essex County Soccer Association to the Ontario Soccer Association.

Registrants and/or registered organizations who wish to seek leave to appeal a decision will have fourteen (14) days
from the date on which they received notice of the decision together with their rights of appeal, to submit in writing notice of the following: (Note: this is for appeals to the OSA only)

Policy 4.1

a) Their intention to appeal,
b) Grounds for the appeal, see 4.2;
c) All evidence that supports these grounds, including all documents;
d) The remedy or remedies requested;
e) A copy of the written decision being appealed, or the Appellant's understanding of the decision (if
the decision has not been received, in writing, by the Appellant);
f) A signature of the Appellant or authorized representative of the Appellant;
g) Evidence that any outstanding fine, fee or bond has been paid;
h) Include the Appeal Fee in accordance with Operational Policy Section 9.0 Policy 15.0 Table 12
in the form of a recorded payment for appeals to the OSA or as per the Governing Organization’s
published schedule of fees, fines bond’s and penalties;
i) Complete and submit the Appeal Template for all requests for Leave to Appeal to the OSA (see
appendix 2).

Policy 4.2

Not every decision may be appealed. Decisions may only be appealed, and appeals may only be heard,
upon the following grounds:
a) Making a decision for which the Respondent did not have authority or jurisdiction as set out in
applicable governing documents;
b) New facts were not available when the decision was made;
c) Failing to properly interpret the relevant Published Rules;
d) Failing to follow procedures as laid out in the relevant Published Rules; or
e) Making a decision that was influenced by bias;
f) Alleged excessive fine, fee, penalty or bond.

Policy 4.3

If the requirements of Policy 4.1 are not met within the14-day period, the request will be ruled out of order and
will not be heard.

The appeal must be submitted in writing registered mail or recognized Courier Service or by hand-delivery or by fax of by e-mail to:

When registered mail or recognized Courier Service is used to submit the appeal, it must be postmarked or dated no more than fourteen (14) days form the receipt of the decision rendered by the Essex County Soccer Association.

It is the responsibility of the Governing Organization (ie., in this case, The Ontario Soccer Association) to advise all relevant parties about the appeal and to provide a copy of the appeal.

If the appeal is upheld, the appeal fee will be returned to the appellant, an administrative fee will be charged
to the Respondent If the appeal is ruled out of order an administrative fee will be withheld by the OSA.
